Terms of Service

These Terms of Service ("Terms") govern your use of the Fivy website and service (the "Service"), operated by Felipe do Amaral Mesquita (ABN 64 517 259 535), trading as Fivy ("Fivy", "we", "us" or "our"), based in New South Wales, Australia. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.
The Service
Fivy brings your Google reviews into one place, drafts suggested replies using AI, and shows you insights about your reviews. Fivy does not post replies on your behalf — suggested replies are drafts that you review, edit and choose to publish yourself (for example by copying them to Google). You remain responsible for anything you post.
Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- You're responsible for the accuracy of the information you provide and for keeping your account secure.
- You're responsible for activity that occurs under your account.
- You must only connect a business you own or are authorised to manage.
Plans, billing and cancellation
- Fivy offers a Free plan and a paid Pro plan (A$29 per month). A Business plan is available on enquiry.
- Paid subscriptions are billed in advance through our payment provider, Stripe, and renew automatically each period until cancelled.
- You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and you keep access until then.
- Except where required by law (including the Australian Consumer Law), payments are non-refundable and we don't provide refunds for partial billing periods.
- We may change our prices or plans; we'll give you reasonable notice before a change affects you, and price changes don't apply to the period you've already paid for.
Acceptable use
You agree not to:
- use the Service unlawfully, or to infringe anyone's rights;
- attempt to disrupt, reverse engineer, scrape, or gain unauthorised access to the Service;
- resell or provide the Service to third parties except as permitted by your plan; or
- use the Service to send spam or to publish content that is unlawful, misleading or harmful.
AI-generated content
Suggested replies and insights are generated by AI and may be inaccurate, incomplete or unsuitable. They are drafts only. You are responsible for reviewing any content before you publish it under your business's name, and for ensuring it is accurate and appropriate.
Third-party data and services
The Service relies on third parties (including Google and Outscraper for review data, and the providers listed in our Privacy Policy). We don't control these services and can't guarantee the accuracy, completeness or availability of data obtained through them. Your use of third-party services may also be subject to their own terms.
Intellectual property
We own the Service and all related software, design and content (excluding your data and your reviews). You retain ownership of your content. You grant us the limited rights needed to operate the Service for you (for example, to process your reviews and generate replies).
Availability
We aim to keep the Service available and reliable, but we provide it on an "as is" and "as available" basis and may modify, suspend or discontinue features from time to time.
Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, which cannot be lawfully excluded. Where our liability for failing to comply with such a guarantee can be limited, our liability is limited (at our option) to re-supplying the Service or paying the cost of having it re-supplied.
Limitation of liability
To the maximum extent permitted by law, and subject to the section above, we are not liable for indirect, incidental or consequential loss, or for loss of profits, revenue, data or goodwill, arising from your use of the Service. To the extent we are liable, our total liability is limited to the amount you paid us for the Service in the 12 months before the claim.
Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that may cause harm or legal risk. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers and liability) will continue to apply.
Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above and, for significant changes, take reasonable steps to let you know. Continuing to use the Service after an update means you accept the revised Terms.
Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state.
